القسم 2 - منتجاتنا

القسم 4 - الأسعار والفوترة

الأسعار والخصومات والعروض الترويجية قابلة للتغيير دون إشعار مسبق. السعر المطبق على المنتج أو الخدمة سيكون السعر الساري في وقت تقديم الطلب، وسيتم تحديده في رسالة تأكيد الطلب عبر البريد الإلكتروني.

ما لم يُنص صراحة على خلاف ذلك، فإن الأسعار المعروضة لا تشمل الضرائب أو رسوم الشحن أو المناولة أو الجمارك أو رسوم الاستيراد.

قد تختلف الأسعار المنشورة في متاجرنا الإلكترونية عن الأسعار في المتاجر الفعلية أو المتاجر الأخرى التي تديرها أطراف ثالثة. قد نقدم من وقت لآخر عروضًا ترويجية ضمن الخدمات، وهذه العروض تخضع لشروط وأحكام منفصلة عن شروط الخدمة الحالية. في حال وجود تعارض بين شروط العرض وهذه الشروط، فإن شروط العرض هي التي تسري.

أنتم توافقون على تقديم معلومات شراء ودفع دقيقة وكاملة وحديثة لجميع المشتريات. كما توافقون على تحديث حسابكم ومعلوماتكم (بما في ذلك البريد الإلكتروني وأرقام البطاقات الائتمانية وتواريخ انتهاء الصلاحية) بشكل فوري ليتمكن النظام من إتمام المعاملات والتواصل معكم عند الحاجة.

القسم 5 - الشحن والتسليم

القسم 6 - الملكية الفكرية

تسمح لكم هذه الشروط باستخدام الخدمات فقط لأغراض شخصية وغير تجارية. ولا يجوز لكم إعادة إنتاج أو توزيع أو تعديل أو إنشاء أعمال مشتقة أو عرضها علنًا أو أداؤها علنًا أو إعادة نشرها أو تنزيلها أو تخزينها أو نقل أي من المواد المتوفرة ضمن الخدمات دون موافقة خطية مسبقة منّا.

باستثناء ما هو منصوص عليه صراحة هنا، لا تمنحكم هذه الشروط أي ترخيص أو حقوق تحت أي براءة اختراع أو علامة تجارية أو حقوق طبع أو أي ملكية فكرية أخرى تخص مدينة ألعاب وندرلاند بغداد أو Shopify أو أي طرف ثالث. إن الاستخدام غير المصرح به للخدمات قد يشكل انتهاكًا لقوانين الملكية الفكرية.

جميع الأسماء والشعارات وأسماء المنتجات والخدمات والتصاميم والشعارات الخاصة بمدينة ألعاب وندرلاند بغداد هي علامات تجارية تابعة لها أو للشركات المرتبطة بها أو للمرخّصين لها. ولا يجوز استخدام هذه العلامات التجارية دون إذن خطي مسبق. أما اسم Shopify وشعاراتها فهي علامات تجارية مملوكة لشركة Shopify. جميع الأسماء والشعارات الأخرى المذكورة في الخدمات تعود ملكيتها لأصحابها.

القسم 7 - الأدوات الاختيارية

قد نتيح لكم الوصول إلى أدوات مقدمة من أطراف ثالثة كجزء من الخدمات، ونحن لا نراقبها ولا نتحكم بها ولا نؤثر عليها.

أنتم تقرون وتوافقون على أن هذه الأدوات متاحة "كما هي" و"حسب توفرها" دون أي ضمانات أو شروط من أي نوع، ودون أي مصادقة من جانبنا. ولا نتحمل أي مسؤولية تنشأ عن استخدامكم لهذه الأدوات المقدمة من أطراف ثالثة.

إن استخدامكم لهذه الأدوات يتم على مسؤوليتكم الخاصة، ويجب عليكم التأكد من أنكم على دراية بالشروط والأحكام الخاصة بمقدمي هذه الأدوات قبل استخدامها.

كما قد نقدّم في المستقبل ميزات جديدة من خلال الخدمات (بما في ذلك أدوات وموارد إضافية)، وتُعتبر هذه الميزات جزءًا من الخدمات وتخضع لشروط الخدمة هذه.

القسم 8 - الروابط التابعة لجهات خارجية

قد تحتوي الخدمات على مواد وروابط لمواقع إلكترونية يديرها أو يوفرها أطراف ثالثة (بما في ذلك وظائف مدمجة). نحن غير مسؤولين عن فحص أو تقييم المحتوى أو دقة أي مواد أو مواقع تابعة لجهات خارجية تختارون الوصول إليها. إذا قررتم مغادرة خدماتنا للوصول إلى هذه المواقع أو المواد، فإنكم تتحملون كامل المخاطر.

من خلال استخدام الخدمات، أنتم تقرون وتوافقون على أن Shopify ليست مسؤولة عن أي جانب من جوانب المبيعات بينكم وبين مدينة ألعاب وندرلاند بغداد، بما في ذلك أي إصابة أو ضرر أو خسارة ناتجة عن المنتجات أو الخدمات المشتراة. وبذلك، أنتم توافقون صراحة على إبراء ذمة Shopify وشركاتها التابعة من جميع المطالبات أو الأضرار أو المسؤوليات الناشئة عن معاملاتكم مع مدينة ألعاب وندرلاند بغداد.

القسم 10 - سياسة الخصوصية

نظرًا لأن الخدمات مستضافة من قبل Shopify، فإن Shopify تجمع وتعالج معلومات شخصية عن وصولكم واستخدامكم للخدمات من أجل توفيرها وتحسينها. المعلومات التي تقدمونها من خلال الخدمات سيتم نقلها ومشاركتها مع Shopify وكذلك مع أطراف ثالثة قد تكون موجودة في دول أخرى غير الدولة التي تقيمون فيها، وذلك بغرض تقديم الخدمات لكم.

القسم 11 - الملاحظات والتعليقات

إذا قمتم بتقديم أو تحميل أو نشر أو إرسال بالبريد الإلكتروني أو نقل أي أفكار أو اقتراحات أو تعليقات أو مراجعات أو خطط أو محتويات أخرى (ويُشار إليها مجتمعة بـ "التعليقات")، فإنكم تمنحون لنا ترخيصًا دائمًا وعالميًا وقابلاً للترخيص من الباطن وخاليًا من الإتاوات لاستخدام هذه التعليقات أو إعادة إنتاجها أو تعديلها أو نشرها أو توزيعها أو عرضها في أي وسيلة ولأي غرض، بما في ذلك الأغراض التجارية.

نحتفظ بحقوقنا بموجب هذا الترخيص في تشغيل وتقديم وتقييم وتحسين وتعزيز الخدمات والترويج لها، وكذلك الوفاء بالتزاماتنا وممارسة حقوقنا بموجب شروط الخدمة.

أنتم تقرون وتتعهدون بما يلي:

أنكم تملكون جميع الحقوق اللازمة لهذه التعليقات.
أنكم كشفتم عن أي حوافز أو تعويضات مرتبطة بتقديم هذه التعليقات.
أن التعليقات لا تنتهك هذه الشروط.

نحن غير ملزمين بـ:

الحفاظ على سرية التعليقات.
دفع أي تعويض مقابل التعليقات.
الرد على أي تعليقات.

يجوز لنا – دون التزام – مراقبة أو تعديل أو إزالة أي تعليقات نراها غير قانونية أو مسيئة أو تهديدية أو تشهيرية أو فاحشة أو غير مقبولة أو تنتهك أي حقوق ملكية فكرية أو شروط الخدمة.

أنتم توافقون على أن تعليقاتكم لن تنتهك حقوق أي طرف ثالث، بما في ذلك حقوق الطبع أو العلامات التجارية أو الخصوصية أو السمعة أو أي حق شخصي أو ملكية أخرى. كما توافقون على أن تعليقاتكم لن تتضمن أي محتوى غير قانوني أو مسيء أو بذيء، ولن تحتوي على أي فيروسات أو برمجيات ضارة قد تؤثر على تشغيل الخدمات أو أي موقع آخر.

لا يجوز لكم استخدام عنوان بريد إلكتروني مزيف أو انتحال شخصية أي شخص آخر أو تضليلنا أو تضليل الأطراف الأخرى حول مصدر التعليقات. أنتم تتحملون المسؤولية الكاملة عن أي تعليقات تقومون بها ودقتها. نحن لا نتحمل أي مسؤولية عن التعليقات المنشورة من قبلكم أو من قبل أي طرف ثالث.

القسم 12 - الأخطاء وعدم الدقة والإغفالات

قد تحتوي الخدمات أحيانًا على معلومات تتضمن أخطاء مطبعية أو عدم دقة أو إغفالات قد تتعلق بأوصاف المنتجات أو الأسعار أو العروض الترويجية أو العروض أو رسوم الشحن أو أوقات النقل أو التوافر.

نحتفظ بالحق في تصحيح أي أخطاء أو عدم دقة أو إغفالات، وكذلك في تغيير أو تحديث المعلومات أو إلغاء الطلبات إذا كانت أي من هذه المعلومات غير صحيحة في أي وقت دون إشعار مسبق (بما في ذلك بعد تقديم الطلب).

القسم 13 - الاستخدامات المحظورة

يمكنكم الوصول إلى الخدمات واستخدامها لأغراض قانونية فقط. ولا يجوز لكم استخدامها بشكل مباشر أو غير مباشر في أي مما يلي:

لأغراض غير قانونية أو ضارة.
لانتهاك أي قوانين أو أنظمة محلية أو دولية.
لانتهاك حقوق الملكية الفكرية الخاصة بنا أو الخاصة بالآخرين.
لمضايقة أو الإساءة أو التشهير أو الإهانة أو تهديد أي من موظفينا أو أي شخص آخر.
لنقل معلومات كاذبة أو مضللة.
لإرسال أو استقبال أو تحميل أو تنزيل أو استخدام أي مواد لا تتوافق مع هذه الشروط.
لإرسال أي مواد إعلانية أو ترويجية غير مرغوب فيها (مثل البريد المزعج أو الرسائل المتسلسلة).
لانتحال شخصية أي شخص أو جهة أخرى.
للقيام بأي سلوك يقيّد أو يمنع استخدام الآخرين للخدمات أو يضر بسمعة مدينة ألعاب وندرلاند بغداد أو Shopify أو مستخدمي الخدمات.

كما توافقون على عدم:

تحميل أو نقل فيروسات أو أي شيفرات ضارة قد تؤثر على تشغيل الخدمات.
إعادة إنتاج أو نسخ أو بيع أو استغلال أي جزء من الخدمات.
جمع أو تتبع المعلومات الشخصية للآخرين.
استخدام وسائل غير قانونية مثل الاحتيال أو الاصطياد الإلكتروني أو التسلل.
التدخل في ميزات الأمان الخاصة بالخدمات أو أي مواقع أخرى مرتبطة.

نحتفظ بالحق في تعليق أو تعطيل أو إنهاء حسابكم في أي وقت دون إشعار إذا تبين لنا أنكم خالفتم هذه الشروط.

القسم 14 - الإنهاء

يجوز لنا إنهاء هذه الاتفاقية أو وصولكم إلى الخدمات (كليًا أو جزئيًا) وفقًا لتقديرنا الخاص في أي وقت ودون إشعار. وستبقون مسؤولين عن جميع المبالغ المستحقة حتى تاريخ الإنهاء.

تظل بعض الأقسام سارية بعد الإنهاء، بما في ذلك: الملكية الفكرية، التعليقات، الإنهاء، إخلاء الضمانات، تحديد المسؤولية، التعويض، قابلية الفصل، التنازل، الاتفاق الكامل، التعيين، القانون الحاكم، سياسة الخصوصية، وأي بنود أخرى بطبيعتها تبقى نافذة بعد الإنهاء.

القسم 15 - إخلاء الضمانات

جميع المعلومات المقدمة من خلال الخدمات متاحة فقط لأغراض المعلومات العامة. نحن لا نضمن دقة أو اكتمال أو فائدة هذه المعلومات. أي اعتماد تقومون به على هذه المعلومات يكون على مسؤوليتكم الخاصة.

نحن نخلي مسؤوليتنا عن أي أضرار أو التزامات ناجمة عن اعتمادكم أو اعتماد أي زائر آخر للخدمات على هذه المواد.

إلى أقصى حد يسمح به القانون، لا تتحمل مدينة ألعاب وندرلاند بغداد ولا شركاؤها أو مديروها أو موظفوها أو وكلاؤها أو المتعاقدون معها أو مزودو خدماتها أو المرخّصون لها، وكذلك Shopify وشركاتها التابعة، أي مسؤولية عن أي إصابة أو خسارة أو مطالبة أو أضرار مباشرة أو غير مباشرة أو عرضية أو عقابية أو خاصة أو تبعية من أي نوع، بما في ذلك على سبيل المثال لا الحصر: خسارة الأرباح، أو خسارة الإيرادات، أو خسارة المدخرات، أو فقدان البيانات، أو تكاليف الاستبدال، أو أية أضرار مشابهة، سواء كانت قائمة على العقد أو المسؤولية التقصيرية (بما في ذلك الإهمال) أو المسؤولية الصارمة أو غيرها، الناشئة عن استخدامكم للخدمات أو أي منتجات يتم شراؤها من خلالها، أو لأي مطالبة أخرى تتعلق باستخدامكم للخدمات أو المنتجات، بما في ذلك أي أخطاء أو إغفالات في أي محتوى، أو أي خسارة أو ضرر من أي نوع ينتج عن استخدام الخدمات أو أي محتوى (أو منتج) يتم نشره أو نقله أو إتاحته بأي شكل عبر الخدمات، حتى لو تم التنبيه بإمكانية وقوعها.

القسم 17 - التعويض

أنتم توافقون على تعويض مدينة ألعاب وندرلاند بغداد وShopify، وشركاتهما التابعة وشركاؤهما ومديريهما وموظفيهما ووكلائهما ومتعاقديهما ومرخّصيهما ومزودي خدماتهما، وحمايتهم من أي خسائر أو أضرار أو مسؤوليات أو مطالبات، بما في ذلك أتعاب المحاماة المعقولة، تُدفع لأي طرف ثالث نتيجة أو مرتبطة بـ:

خرقكم لشروط الخدمة أو المستندات المشار إليها فيها.
انتهاككم لأي قانون أو حقوق طرف ثالث.
وصولكم إلى الخدمات أو استخدامكم لها.

سنخطركم بأي مطالبة مشمولة بالتعويض، على أن عدم الإخطار في الوقت المناسب لا يعفيكم من التزاماتكم إلا إذا تضررتم بشكل مادي. لنا الحق في الدفاع عن هذه المطالبات وتسويتها على نفقتكم، بما في ذلك اختيار المحامي، لكننا لن نوافق على أي تسوية تفرض عليكم التزامات غير مالية دون موافقتكم (التي لا ينبغي حجبها دون مبرر). وعليكم التعاون في الدفاع عن المطالبات، بما في ذلك تقديم الوثائق ذات الصلة.

القسم 18 - قابلية الفصل

إذا تبين أن أي حكم من شروط الخدمة هذه غير قانوني أو باطل أو غير قابل للتنفيذ، فإن ذلك الحكم سيظل قابلًا للتنفيذ إلى أقصى حد يسمح به القانون، وسيُعتبر الجزء غير القابل للتنفيذ منفصلًا عن شروط الخدمة. ولا يؤثر هذا التحديد على صلاحية ونفاذ الأحكام الأخرى المتبقية.

القسم 19 - التنازل والاتفاق الكامل

إن عدم ممارستنا أو تنفيذنا لأي حق أو حكم من شروط الخدمة لا يشكل تنازلاً عن هذا الحق أو الحكم.

تشكل شروط الخدمة هذه وأي سياسات أو قواعد تشغيل منشورة من قبلنا على الموقع الاتفاق الكامل والتفاهم بينكم وبيننا، وتحكم استخدامكم للخدمات، وتحل محل أي اتفاقيات أو اتصالات أو مقترحات سابقة أو حالية، سواء كانت شفهية أو مكتوبة، بينكم وبيننا (بما في ذلك أي نسخ سابقة من شروط الخدمة).

أي غموض في تفسير شروط الخدمة هذه لن يُفسَّر ضد الطرف الذي صاغها.

القسم 20 - التعيين
